WHAT IS A NOTARY?​

A notary public is an individual who is authorized to witness the signing of legal documents such as deeds, powers of attorney, letters, affidavits, and trusts. As a publicly commissioned official working under and appointed by the secretary of state, a notary is tasked with identifying a signer and verifying their signature.  They serve as an impartial witness during the signing of legal documents.

DUTIES OF A NOTARY​

A notary’s main duty is to prevent fraud by taking specific steps in properly screening a signer’s identity and witnessing a signer’s signature . They can also certify copies of powers of attorney, administer oaths or affirmations, and take depositions.

REQUIREMENTS

  1. The signer must physically appear face to face before a notary public in the same room and be able to communicate with the notary.
  2. The signer is fully aware of the document their signing and most importantly have a willingness to sign.
  3. The signer must present the notary with an original valid legal picture ID: California Driver’s License or ID Card, Out of State Driver’s License or ID Card, Canadian Driver’s License, Mexican Driver’s License, US Passport, Foreign Passport (Stamped by USCIS), US Military ID Card, Inmate ID Card, Federal/State/County/Ca. City Employee ID, ID from a federally recognized tribal government.  
  4. The signer’s document is complete.  There are no blank spaces or just a blank page.
